HEY-GO PLATFORM - TERMS OF SERVICE & USER AGREEMENT

Welcome to Hey-Go ("Platform", "We", "Us", "Our"). Hey-Go operates as an online marketplace aggregator that facilitates transaction-enabling services between registered third-party sellers/vendors ("Sellers"), independent logistics delivery partners ("Delivery Partners"), and end-user buyers ("Users", "You").
By accessing, downloading, or using the Hey-Go website, mobile application, or associated services, you agree to be bound by these Terms & Conditions.
1. Platform Nature & Role (Pure Intermediary Status)
Marketplace Model: Hey-Go operates strictly as an electronic marketplace under the Information Technology Act, 2000. Hey-Go does not own, manufacture, package, store, re-sell, or hold inventory of any products sold on the platform, including Grocery Items, Chips & Namkeen, Dairy Products, Apparel/Clothing, Mobile Accessories, or Consumer Electronics.
Third-Party Sellers: All products listed on Hey-Go are offered, priced, sold, and fulfilled directly by independent third-party vendors/sellers listed on the Platform.
Contractual Relationship: When you place an order on Hey-Go, a direct contract of sale is formed strictly between You and the Seller. Hey-Go is not a party to this sale contract, nor does it assume any obligations arising out of it.
2. Product Disclaimers & Absolute Non-Liability
A. Grocery, Food, & Dairy Products
Quality & Freshness: Sellers are solely responsible for compliance with food safety, manufacturing dates, shelf life, expiration, and quality standards (e.g., FSSAI compliance).
Health & Allergies: Hey-Go is not liable for any illness, allergic reactions, food poisoning, or health hazards resulting from dairy, packaged foods, or grocery items purchased from Sellers through the Platform.
B. Clothing, Apparel, & Footwear
Size & Fitting: Colors, textures, and sizes shown in product images are provided by Sellers. Hey-Go makes no guarantees regarding precise color match, fabric quality, or fit accuracy.
Counterfeit & IP Claims: Sellers warrant that all apparel items sold are genuine. Hey-Go accepts zero liability for trademark or intellectual property violations by third-party fashion Sellers, but will act in compliance with takedown notices.
C. Electronics & Mobile Accessories
Manufacturer Warranty: All mobile phones, chargers, earbuds, power banks, and electronics are sold under the manufacturer’s or Seller's original warranty, if applicable. Hey-Go provides no independent warranties, performance guarantees, or technical support.
Defects & Damage: Hey-Go is not liable for manufacturing defects, battery failures, electrical hazards, or hardware malfunctions. Any warranty claims must be taken up directly with the product manufacturer or listed Seller.
3. Pricing, Promotional Discounts & Offers
MRP & Pricing: Product prices are set by the respective Sellers.
Hey-Go Promotional Offers (e.g., ₹5 OFF Below MRP): Hey-Go may run platform-wide promotional discounts (such as ₹5 off below MRP). Hey-Go reserves the right to modify, adjust, suspend, or terminate any instant discount, campaign, or cashback offer at its sole discretion without prior notice.
4. Logistics & Delivery Disclaimer
Independent Delivery Partners: Delivery services are fulfilled by independent third-party delivery contractors. They are neither employees, agents, nor direct representatives of Hey-Go.
Delivery Timelines: Any delivery times quoted on the app (e.g., 10-minute or same-day delivery estimates) are approximations based on traffic, weather, and vendor dispatch speed. Hey-Go disclaims all liability for delayed deliveries or indirect damages resulting from delivery delays.
Transit Damage: Any damage caused to products during transit is the responsibility of the Seller or Delivery Partner.
5. Returns, Refunds & Cancellations
Seller Return Policies: Return, exchange, and refund eligibility depends on the specific category rules set by Sellers (e.g., non-returnable dairy/perishables vs. returnable electronics/apparel).
Hey-Go's Role: Hey-Go acts solely as a payment facilitator for authorized refunds. If a refund is approved by the Seller, funds will be processed back to the original payment method. Hey-Go reserves the right to reject refund requests deemed fraudulent or in violation of platform policy.
6. Limitation of Liability & Maximum Financial Cap
To the maximum extent permitted under applicable law:
Indirect Damages: Hey-Go, its parent company, directors, employees, or partners shall never be held liable for any indirect, incidental, consequential, special, or punitive damages (including loss of profits, loss of data, personal injury, or property damage) arising out of your use of the Platform.
Maximum Monetary Cap: Under all circumstances, Hey-Go's maximum cumulative liability for any claim arising out of an order shall not exceed the refund of the exact amount paid by you for the specific item in question.
7. User Indemnification
You agree to defend, indemnify, and hold harmless Hey-Go, its affiliates, directors, officers, employees, and partners from and against any third-party claims, liabilities, costs, losses, or legal fees arising from:
Your breach or violation of these Terms of Service.
Your violation of any applicable law or third-party rights (including intellectual property or privacy rights).
Abusive, discourteous, or illegal behavior toward Delivery Partners or Customer Support personnel.
8. Platform Usage & Account Termination
Hey-Go reserves the right to immediately suspend, block, or permanently delete any user account without prior notice if we detect:
Fraudulent transactions, fake orders, or abuse of discount offers/coupons.
Abusive, threatening, or harmful conduct toward Sellers, Delivery Partners, or Hey-Go staff.
Attempting to hack, scrape, or disrupt the Hey-Go app, website, or infrastructure.
9. Governing Law & Dispute Resolution
Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of India.
Courts: Any legal dispute, arbitration, or proceeding arising out of or related to Hey-Go shall fall under the exclusive jurisdiction of the competent courts in your city/state of operational headquarters.
